Part of the perfunctory claim building process is determining the facts, how the accident happened, who was involved, where the accident occurred, date and time, things that. And a insurance company, an insurance company can't make a determination about faults, their liability, the coverage, things of that nature, unless they have all of that information. Is it smart to talk to them without an attorney? Probably not. If it's a case where somebody stopped and they get rear-ended and they're talking to the other driver's insurance company, the car that rear-ended them when they were stopped, I'm not terribly concerned about a situation that. However, if it's a case where there may be a light dispute that both parties are saying that they had the green light or if it's a lane merge accident, then yes, I think it's very important that you have an attorney either with you on the phone or sometimes we're able to issue written statements and we can send an email or a letter to the insurance company documenting our client's recollection of the facts and how the accident happened. So you have to speak to them. Whether or not you have an attorney with you or overseeing you or guiding you can be fact-specific, but just in case, I would always recommend that because the insurance company, whether it's your company or whether it's the defense, the person who hit you, their insurance company, none of them are your friends. They only wanna figure out how they don't have to pay money. So if they can try to trip you up or get you to say something while giving them a statement of how the accident happened, they're going to take advantage of that. So most certainly, I would always recommend an attorney, but if you did give a statement and you didn't have an attorney and you didn't consult an attorney beforehand, that isn't fatal and doesn't mean your case is over.
