So, somebody can be negligent, but not necessarily be the proximate cause of an accident., their car could not have an up-to-date inspection sticker, or they could have a broken turn signal, or they could, in fact, be driving over the speed limit. They could be driving five miles an hour over the speed limit, but that increase in speed may not be a proximate cause to the accident. So, unless a person's negligence can be directly linked to why the accident happened, then they are not barred for pursuing the other person. So, it is more important and very important that you speak with an attorney right away and let them know the facts of the accident, because most certainly, that is going to dictate how the next steps you take unfold, such as the treatment you might get, or depending on what insurance coverage you have, are you going to get compensated for your car or your injuries, do you get a rental car, things of that nature. So, it's always important, particularly if you think that you have possibly contributed to an accident, to speak with an attorney ASAP to see if you still have a good faith basis to move forward against the other person who was involved in the accident, which is going to probably and most likely dictate your next steps regarding handling any claims.
