When can the police search my car without a warrant?

In California, there are several circumstances under which law enforcement can search a vehicle without obtaining a warrant. The most common scenario occurs when an individual provides consent for the search. If a driver willingly allows the police to search their vehicle, no warrant is necessary. Another circumstance is when law enforcement has probable cause to believe that evidence of a crime is present within the vehicle. Additionally, if an individual is arrested, police may perform a search incident to a lawful arrest. Individuals have the right to refuse consent for a search; however, it is advisable not to physically resist the search.
