Is it hard to fight somebody who's taken my brand name? It's going to depend on a couple factors, things if you have a registered trademark, if you have the receipts, what your dates of use are versus the other party. Fighting the other party can sometimes look a cease and desist, action through the Trademark Trials and Appeals Board, and even litigation if it gets that far. If you don't have a trademark registration, you're not completely unarmed, but you are coming way far from behind. I have to prove common law rights, which is a much harder, much slower process, and in general just far more difficult to do. Plus more expensive. Truthfully, a lot of these fights never even make it to court. They settle way beforehand, but how quickly they're settled almost always comes down to who registered first and who's been using it the longest.
