Do I need a trademark, or is an LLC enough to protect my brand? Short answer, no, it's not going to do enough. An LLC is going to protect you in different ways than a trademark will. An LLC is going to protect you, your personal assets, your business structure, but forming and filing an LLC and registering your name with your state is not the same as formally registering your trademark with the USPTO. Forming your LLC is also not going to give you exclusive rights to use your name, your logo, or your slogan. A trademark is the thing that's going to protect the brand that you're building, that you're marketing, everything that you're investing, time, money, anything into, a trademark is what's going to protect that. If your brand matters to you and you'd be upset if you could no longer use your business name, then yes, a trademark is very much worth looking into.
