Who Keeps the Engagement Ring After a Breakup in New York? NYC Lawyer Explains

The Wedding Is Off. Who Gets the Ring?

The relationship is over. The wedding is canceled. But there's one expensive question nobody wants to ask.

Who gets to keep the engagement ring?

You might assume the answer depends on who ended the relationship. Maybe one person cheated. Maybe someone got cold feet. Maybe the couple simply realized marriage wasn't right for them.

But in New York, the law generally doesn't care who broke whose heart.

NYC lawyer Jasmine Weg (@jasminewegesq) explains why.

Is an engagement ring a gift in New York?

Yes, but there's an important distinction.

Under New York law, an engagement ring is generally considered a conditional gift.

Unlike a birthday present or an anniversary gift, an engagement ring is typically given with the expectation that a marriage will take place.

That marriage is the condition attached to the gift.

If the marriage happens, the condition is fulfilled. If it doesn't, the person who gave the ring generally has the right to get it back.

Does it matter who called off the wedding?

Here's where things get interesting.

New York generally follows a no-fault approach when determining who gets an engagement ring after a broken engagement.

That means the court usually isn't interested in deciding who was responsible for the breakup.

Whether one person cheated, changed their mind, or walked away weeks before the wedding generally doesn't change the outcome.

The ring typically goes back to the giver.

What if the person who received the ring refuses to return it?

If the couple can't agree on returning the ring, the person who purchased or gave it may be able to pursue its return through legal action.

New York Civil Rights Law § 80-b provides a legal basis for recovering property transferred in contemplation of a marriage that never occurred.

However, the circumstances surrounding the gift matter. For example, a ring given as an unconditional gift rather than specifically in contemplation of marriage may be treated differently.

What if the ring was given on a birthday or holiday?

Timing alone doesn't necessarily determine whether the ring is a conditional gift.

What matters is the purpose of the gift and the circumstances surrounding it.

If the ring was given as part of a marriage proposal, it may still be considered conditional even if the proposal happened on Valentine's Day, Christmas, or a birthday.

What if the couple actually got married?

That's a different situation.

Once the marriage takes place, the condition attached to the engagement ring has generally been satisfied.

If the couple later divorces, the ring is ordinarily treated differently from a ring involved in a broken engagement.

The Lawggle Takeaway

An engagement ring might symbolize forever, but in New York, its ownership can depend on whether the wedding actually happens.

No wedding? The ring generally goes back to the giver.

And as Jasmine explains, the law doesn't necessarily care who ended the relationship.

Frequently Asked Questions

Who legally owns an engagement ring in New York?

If a couple never marries, the person who gave the engagement ring generally has the right to recover it because it was a conditional gift.

Can I keep my engagement ring if my fiancé cheated?

Generally, no. New York's no-fault approach means cheating ordinarily doesn't determine who keeps the ring.

Can someone sue to get an engagement ring back?

Yes. New York Civil Rights Law allows qualifying claims for the return of property given in contemplation of marriage or, in appropriate circumstances, its value.

Does the same rule apply in every state?

No. Engagement ring laws vary by state. Some jurisdictions take different approaches to fault and ownership.
